Plaintiff alleged she was injured when multiple items fell out of a box onto her body while she was shopping on our client’s premises. Plaintiff alleged that the boxes were stacked improperly causing the items to fall out and strike plaintiff. The plaintiff claimed that our client created the condition and had notice of it. However, we successfully established that the evidence was insufficient for plaintiff to establish that the defendant was responsible for the alleged dangerous condition. The Court also found that our client did not have actual notice of a dangerous condition, as there was no evidence indicating prior accidents or complaints regarding the subject boxes. Moreover, the Court found that there was no constructive notice, as our client conducted regular inspection of the accident location and did not report any dangerous conditions.
