Scott H. Wertheimer is an associate at Simmons Jannace DeLuca, LLP. His practice focuses on general liability defense. Mr. Wertheimer has degrees from Touro College, Jacob D. Fuchsberg Law Center (J.D., 2006) and from Binghamton University, State University of New York (B.A., Psychology, 2002). He is admitted to practice law in New York State and in the U.S. District Court, Eastern and Southern Districts. Mr. Wertheimer has 15 years of litigation experience focusing on bodily injury and no-fault insurance litigation. Prior to his association with Simmons Jannace DeLuca, LLP, Mr. Wertheimer served as in-house counsel for a leading insurance carrier with a practice focused on the defense of no-fault litigation. He managed a high-volume caseload from inception to resolution, including all aspects of discovery, conducting examinations under oath, motion practice, bench trials, arbitrations, and settlement negotiations. Mr. Wertheimer regularly appeared in court in all five boroughs, in addition to the district courts located in Nassau and Suffolk Counties.
In addition, Mr. Wertheimer has extensive experience in private practice representing individual clients in personal injury litigation, and insurance carriers in insurance defense litigation. He successfully defended insurance carriers in a federal mass tort litigation involving more than ten thousand plaintiffs relating to the clean-up at the World Trade Center following the terrorist attacks on 9/11. This entailed extensive analysis of medical records, discovery documents, and insurance coverage issues. Further, Mr. Wertheimer represented insurance carriers in a wide range of general liability matters from inception to resolution, including all aspects of discovery, taking/defending depositions, court appearances, motion practice and settlement negotiations. He represented clients in personal injury actions including, motor vehicle accidents, premises liability, construction site accidents, products liability, medical malpractice, and employment discrimination.
