This case involved a motor vehicle accident between plaintiff and co-defendant at a traffic intersection at the Roosevelt Field Mall. Plaintiff claimed that the traffic light at the intersection was not working. We moved for summary judgment. We argued that plaintiff failed to show any defect with the traffic light. We relied upon the testimony of all parties including the two non-party witnesses who testified that plaintiff ran a red light. The Court agreed that there was no triable issues of fact and granted our motion.
