The assignee of a debt attempted to collect from the plaintiff debtor. The plaintiff sued our bank client claiming it violated the Debtor’s discharge. Plaintiff voluntarily discontinued the proceedings in response to our argument in our motion to dismiss that the debt collector was not an agent of the bank and therefore, the bank did not engage in any post-petition debt-collection activities.
