Plaintiff commenced an action in Supreme Court, Suffolk County against our client, a large national retailer. Plaintiff, who since moved to Florida, alleged he slipped and fell on ice in the parking lot adjacent to the store. We moved for dismissal of plaintiff’s action on the ground that plaintiff refused to return to New York for an independent physical examination by defendant’s physicians. The Court granted our motion and dismissed plaintiff’s claim.
